Litigation Costs - What a solicitor must tell you

When you instruct a solicitor to assist you with court proceedings, you will be provided with certain information about the way in which that solicitor will act, and what the costs are likely to be.

The details that solicitors are required to give are contained in the main in Rule 2 of the Solicitors Code of Conduct - and it isn't just limited to costs.

As regards costs, the Solicitors Code of Conduct requires in Rule 2.03(6) that solicitors

"must discuss with your client whether the potential outcomes of any legal case will justify the expense or risk involved including, if relevant, the risk of having to pay an opponent’s costs".

The solicitor "must" provide the client with "the best information possible about the likely overall cost of a matter". This duty is on-going, so the solicitor will need to supply updated costs information as your matter progresses.

This is an important part of planning cost effective litigation - and is essential for all clients to consider before they become involved in litigation.
