Terms & Conditions when dealing with Consumers

The Office of Fair Trading has recently obtained a court order requiring an estate agent to amend its terms of business with consumer landlords. The Court had ruled in 2009 that the estate agent’s terms relating to renewal commission terms were unfair and not transparent.

This decision is important for businesses in many other industry sectors which sell their products and services to consumers. This is because it highlights that important terms, particularly those which may disadvantage consumers, must be clear, prominent and actively brought to consumers’ attention.
